Terms and Conditions of Service
These Terms and Conditions (“Agreement”) govern the use of photo booth rental services (“Services”) provided by Melbooth Magic (“Company,” “We,” “Our,” “Us”) to the customer (“Customer,” “You,” or “Your”). By accessing or using our Services, you agree to abide by these terms. If you do not agree with these terms, you may not use the Services.
Booking and Reservations
1.1 Booking Confirmation
A booking is not considered confirmed until the Customer has submitted the completed booking form and made the necessary deposit payment. The Company reserves the right to cancel or reschedule any booking at its discretion, with a full refund issued in such cases.
1.2 Deposit and Payments
A non-refundable deposit is required to secure the booking. The remaining balance is due at least 14 days prior to the event date. Failure to make timely payment may result in the cancellation of the booking, and the deposit will be forfeited.
1.3 Late Bookings
If a booking is made within 14 days of the event, full payment is required within 48 hours of booking. Bookings made within 7 days of the event require immediate full payment
Cancellation and Refund Policy
2.1 Customer-initiated Cancellation
If the Customer wishes to cancel the booking, the following refund policy applies:
Cancellations made 14 days or more prior to the event date will result in a refund of the balance paid, less the non-refundable deposit.
Cancellations made within 14 days of the event date will forfeit all payments made, unless otherwise agreed by the Company.
2.2 Company-initiated Cancellation
The Company reserves the right to cancel any booking due to unforeseen circumstances or if it determines that the event violates its policies or local laws. In such cases, the Customer will receive a full refund.
Liability and Indemnity
3.1 Customer Responsibility
The Customer is fully responsible for the behavior of all event participants using the photo booth. Any damage to the photo booth, related equipment, or props caused by the Customer or event participants will result in the Customer being held financially responsible for repairs or replacement.
3.2 Limitation of Liability The Company shall not be held liable for any loss, injury, or damage arising out of the use of its services, including but not limited to direct, indirect, incidental, or consequential damages. In no event shall the Company’s liability exceed the amount paid for the booking.
3.3 Indemnification
The Customer agrees to indemnify and hold harmless Melbooth Magic, its affiliates, employees, agents, and subcontractors from any claims, liabilities, losses, damages, or expenses (including legal fees) arising from the use of the photo booth or related services.
Equipment and Usage
4.1 Use of Equipment
The photo booth and related equipment must only be used as instructed by the Company. Any misuse, damage, or alteration of the equipment will result in the Customer being held financially responsible for repairs or replacement.
4.2 Access and Setup Requirements
The Customer must ensure that an appropriate environment is provided for the setup and operation of the equipment. The following conditions must be met:
• A clear space of at least 3m x 3m for setup.
• Access to a 240V power outlet within 5 meters of the setup location.
• Access pathways and doorways must be at least 80 cm wide.
• For outdoor events, a flat surface and secondary cover in case of weather are required.
4.3 Site Conditions and Venue Requirements
The Customer is responsible for ensuring the venue can accommodate the setup requirements, including power, internet access (if required), and venue access. The Customer is also responsible for any fees or charges incurred at the venue.
Intellectual Property
5.1 Ownership of Photos
The Customer retains ownership of all photos taken during the event, but the Company reserves the right to use these images for promotional purposes, including but not limited to social media, marketing materials, and the Company’s website.
5.2 Proprietary Materials
All trademarks, logos, and proprietary content provided by the Company, including photo booth software and branding, remain the exclusive property of Melbooth Magic. The Customer is prohibited from reproducing, distributing, or using these materials without the prior written consent of the Company.
Social Media and Marketing
6.1 Social Media Uploads
If the photo booth service includes social media integration, the Customer is responsible for ensuring that the venue has an adequate internet connection. The Company is not liable for issues related to internet connectivity or social media platform outages.
6.2 Permission for Sharing
By using the photo booth, the Customer grants the Company permission to share photos from the event on the Company’s social media accounts, website, and marketing materials.
Force Majeure
7.1 Unforeseen Circumstances
The Company will not be held liable for any delay, failure, or interruption in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, acts of government, labor disputes, or equipment failure.
Governing Law and Dispute Resolution
8.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of laws principles.
Miscellaneous
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Modification: We reserve the right to modify or update these Terms at any time without prior notice. The updated Terms will be effective from the date of publication on our website.
Entire Agreement: These Terms constitute the entire agreement between you and Melbooth Magic regarding the use of our services and supersede any prior agreements or understandings.
